Pulse Fitness Membership Agreement Review & Reference
1. Introduction
Welcome to Pulse Fitness, LLC. Please review the following terms and conditions carefully. By completing your membership registration, you agree to abide by these terms and acknowledge the policies and procedures outlined herein.
2. Membership and Policies
By signing this agreement, you agree to adhere to Pulse Fitness’s membership policies and club rules. Pulse Fitness reserves the right to modify these policies and rules at its sole discretion without prior notice. Pulse Fitness also retains the right to terminate your membership immediately if you violate any membership policies or club rules.
3. Equipment and Services
Access to equipment and services is provided on a first-come, first-served basis. Pulse Fitness may adjust the type or quantity of equipment and alter operational hours at its discretion.
4. Financial Responsibility
You agree to pay for all services rendered by Pulse Fitness. Payment is due upon signing this agreement. Your membership is an Individual Annual Membership. Following enrollment, a monthly payment will be drafted until you provide written notice of cancellation.
You are responsible for all charges incurred and acknowledge that failure to keep your account current will result in restricted access to Pulse Fitness facilities and services.
5. Medical Release and Waiver
You affirm that you are in good health and do not have any medical condition that would limit your ability to use the Pulse Fitness facilities. Pulse Fitness has not provided any medical advice prior to or following your membership enrollment. Consult with a healthcare provider if you have any health concerns before using the facilities.
6. Membership Termination and Suspension
Pulse Fitness, LLC, a private club, may suspend or withdraw membership privileges if, in its sole opinion, your conduct is deemed inappropriate, unacceptable, or detrimental to the club or its members. Termination of membership is effective immediately, and no previous payments will be refunded. If suspended, you forfeit all membership privileges and are not entitled to any refund for suspended periods. Membership may also be terminated for any reason with thirty (30) days written notice. Upon termination, unused fees may be refunded.
7. Membership Agreement
This Agreement includes the Club Policies and Procedures, which are incorporated by reference. Membership becomes effective only when this Agreement is signed by both the Club’s authorized representative and you, the Member.
8. Member Agreements
You agree to:
Familiarize yourself with the Pulse Fitness Membership Guide available online and in the club office.
Abide by all current rules and policies.
Make timely payment of all membership fees and dues.
Understand that membership is non-voting and non-proprietary.
Consult a physician before starting any exercise program.
Wear appropriate attire while using the facility.
Accept that non-attendance does not alter your payment obligations.
9. Club Agreements
Upon acceptance of your membership application, Pulse Fitness agrees to provide membership privileges in accordance with Club Policies. The Club will notify you in writing of any changes in fees or policies thirty (30) days before implementation. You may cancel membership before the next billing date if you do not accept the changes.
10. Fees and Payment
An application fee of $25 and applicable sales tax is required. Monthly dues are payable in full and may be adjusted with thirty (30) days notice. Late payments or returned items are subject to a $35 fee. Failure to pay may result in a breach of this Agreement, and you will be responsible for reasonable attorney’s fees and costs related to enforcement.
11. Cancellation
You may cancel this Agreement within three business days of signing by delivering notice to Pulse Fitness or sending it via registered mail. The Club will refund any payments made, minus a reasonable fee for usage if applicable.
12. Termination
To terminate, provide written notice before the start of the calendar month in which termination is effective. You are responsible for all fees incurred up to the termination date. Membership may be terminated immediately for policy violations or non-payment, with no refunds for prior payments. The Club may also terminate membership for any reason with thirty (30) days written notice, refunding any unused fees.
13. Refund Policy
No refunds or extensions will be provided if the facility is inaccessible due to external circumstances such as acts of God.
14. Relocation
If you relocate more than 25 miles from the club, you may cancel the contract with proof of relocation. A thirty (30) day written notice is required, along with a one-time cancellation fee of $150.00 plus sales tax.
15. Membership Transfer
Memberships can be transferred with both parties present at the club. A $75 transfer fee and management approval are required.
16. Termination Fees
If membership is terminated within twelve (12) months of initiation, a $150 termination fee plus sales tax will apply. No fee applies if terminated after twelve (12) months.
17. Renewal
Membership renews automatically after twelve (12) months. You will receive an email reminder prior to renewal. Notify us in writing if you choose not to renew.
18. Waiver and Release of Liability
By signing this Agreement, you acknowledge the inherent risks associated with physical training and voluntarily assume full responsibility for any injuries or damages resulting from your use of the Club facilities. You release Pulse Fitness, LLC, its employees, agents, and representatives from any liability related to personal injuries, illnesses, or damages sustained during your participation in Club activities.
19. COVID-19 Waiver
You acknowledge the risks associated with COVID-19 and agree to assume all risks related to exposure. You release Pulse Fitness, LLC from any liability related to COVID-19 infections or exposure.
20. Photography/Video Release
You consent to the use of photographs or videos taken during Club activities for promotional purposes without compensation.
21. Indemnification
You agree to indemnify and hold Pulse Fitness, LLC harmless from any claims or damages resulting from your negligence or intentional actions while using the Club facilities.
22. Governing Law
This Agreement shall be governed by the laws of the state of Louisiana.
By selecting a membership below and completing the process to purchase, you confirm that you have read, understood, and agree to all terms and conditions stated herein. If you are purchasing a multi-member membership, this agreement encompasses all members including minors, of whom you also consent to the terms on their behalf.
23. Please note
Memberships do NOT include any privately scheduled trainer sessions. Pulse fitness reserves the right to deem any class as “Not included with your membership”.
